How Much Is A Back Injury Worth In A Car Accident?

If you have been in a car accident and you have sustained a back injury you could well be wondering how much a compensation claim might be worth.

There are a number of factors that can impact on how much a claim for back injury can be worth.

After a car accident, it is very common to sustain a back injury, both neck and back injuries are often caused by a whiplash effect.

How Much Compensation Will I Get?

The value of a claim for compensation for a back injury is determined by a number of factors such as the seriousness of the injury and also the time for recovery of the injury.

For example if you have a very serious back injury in which you have to undergo surgery or it takes months, or even years to recover then that is going to be worth significantly more than a relatively minor back injury which clears up over the course of a number of weeks or 2 to 3 months.

There are also other elements which have to be factored in when calculating compensation for a back injury and these include the effect on your life. This can vary hugely from person to person. For example some people may be into playing sports such as football, golf, running or even just walking and this can be affected by a back injury sustained in a car accident.

Any kind of back injury can have an enormous impact in your day to day life. From your ability to bend down and tie your shoe laces up to simple things such as the ability to work, to making the bed, from getting in and out of the bath, all of these simple tasks can be very badly affected by a back injury.

A recent case that we dealt with regarding a back injury was a man who was involved in a head on collision in which a car was overtaking another vehicle coming in the opposite direction and collided with our client’s vehicle.

We obtained a number of orthopaedic reports dealing with the serious physical injuries that were sustained. Our client was unable to work for nearly a year after the accident but was able to obtain some pay from his employers whilst he was off work. There was also a dispute regarding who was at fault and Court proceedings had to be issued.

We were able to resolve the case without the need for a Court hearing and our client did not have to go to Court. After lengthy negotiations our client obtained compensation for his injuries of £10,000 and also his loss of earnings of £6,000 making a total settlement of £16,000.

How Much Is A Back Injury Worth In A Car Accident?

Many people today suffer from back issues and lower back pain which is one of the most common ailments that people suffer from today. So if you have been in a car accident which has caused a back injury or exacerbated your back injury the amount of compensation you can receive can be very substantial not only because of the impact on your day to day life but also by how long it can take for a back injury to clear up.

After a car accident we would arrange for a medical report to be carried out to assess your injuries and to review how serious your back injury is. The surgeon who will assess your back injury will prepare a report. As part of that report he will give an opinion on how long he thinks your injuries will last for, this can range from 3 to 6 months to over a year depending on how serious the accident was and also how you are recovering from the accident.

If you are involved in a high speed collision in which another vehicle has struck the rear of the vehicle you are travelling in then that is much more likely to cause a very serious injury to your back, rather than a low velocity bump which we often find can cause less serious back injuries, but injuries that can affect your day to day life nonetheless.

The reality of a back injury is that it can take so long to heal because it is an area very vulnerable to injury and is in constant use when you are going about your day to day business. This means that it can be difficult to recover fully from a back injury and often people find that an injury they sustained to their back after a car accident can be with them for years and can still be affecting their lives for a long time to come after the car accident.

Medical Assessment

After an accident as part of the medical assessment that we arrange and the medical report that we obtain, the surgeon will be able to consider how long it will take you to recover from your back injury and we would use this as part of our negotiations regarding your compensation settlement.

It is important to assess whether you need further treatment such as physiotherapy, or even back surgery to deal with problems that arise such as nerve impingement or bulging disks. An accident which causes a serious back injury such as a bulging disk or nerve issues will take longer to resolve. It is important that we are able to properly assess how serious your injuries are and how long it is going to take for you to recover and get back on your feet again. It is important that you are fully compensated after an accident for the injuries and that is why we focus on how long it is going to take you to recover.

Another element of this is the effect on your day to day life and we assess that through our free claim assessment. We discuss with you how this has impacted on any hobbies you may have, your ability to look after children or your family life, and often it can also impact upon your ability to work.

After a car accident if you have sustained a back injury we would highly recommend you speak to an experienced personal injury solicitor who can discuss with you the injuries and the effect on your life and will be able to give you an idea of what your compensation claim might be worth.

We offer a free consultation so that you can speak to one of our team at no cost to you. We will be able to discuss the accident with you and to discuss your injuries and whether you have been to hospital or to see your doctor and we will be able to give you an idea of what we think your claim might be worth going forward.

Some people after an accident do not seek medical treatment, they do not go to their GP or to hospital. We have dealt with many cases of people who after an accident have not sought medical treatment and would just use pain killers themselves to deal with the pain. This does not stop you from claiming after an accident for a back injury. There is a myth that if you do not go to your GP or to hospital after an accident that you are not able to claim, this is not true. We have dealt with many claims of people who have not been to their GP or to hospital after an accident and we have successfully been able to help them claim compensation.

How Much Is My Claim Worth?

To give an idea of how much a claim would be worth after a car accident. If someone has sustained a relatively minor back injury which clears up after 8 to 12 weeks and there are no ongoing issues we would likely see an offer of compensation from an insurance company of between £2,000 to £5,000. This depends on the seriousness of the injury and the effect on the person’s work and home life.

Compensation Calculator

This figure will obviously vary from case to case and we have developed a Compensation Calculator which will also be able to help you get an idea of how much your back injury might be worth after a car accident.
