Police Station Interviews

When the Police knock at the door, or arrest a person at home or elsewhere, the shock of being questioned can be very distressing. What happens at the Police Station can be absolutely critical in deciding the case and we would always advise somebody to have a Solicitor from McGee O’Kane present with them for a Police Station Interview.

If you or a family member are due to go to the police station, just call us now. We are always happy to talk about what to expect. We have also included a guide below explaining the main things that are likely to happen.

The Initial Contact by the Police and the ‘Chat down the Station’

When the police are investigating an allegation, they will often contact a suspect on the telephone, if they have not arrested them already, and invite them to the Police Station for ‘a chat’, often saying things like ‘we need to hear your side of the story’ or ‘I’m neutral in this, and I’m just trying to see what has happened’. This can put a suspect off his guard so that he feels relaxed and cooperates in full with the Police on their terms, often incriminating himself in the process.

It is very important that any communication you ever have with an investigating Police Officer takes place either through a lawyer or in the presence of a lawyer. Even things that you say on the phone to a police officer can in some cases be used in court against you.

Sometimes a police officer will not even explain that coming into the station ‘for a chat’ can mean being interviewed under arrest by appointment. A person can attend at the Police Station on this basis, not having had time to organise the lawyer of their choice beforehand, and find themselves in court the next morning having been kept in a cell overnight with a duty solicitor they did not choose. The solution is to never discuss anything directly with a police officer without having a Solicitor there.

Going to the police station for an interview is never a pleasant experience.

If you or a family member has been contacted or arrested by the police, feel free to call us on 028 71 229 343. Our expert team of Criminal Law Solicitors are happy to assist in stations across Northern Ireland.

What If I Am Arrested by the Police?

When you are arrested, you will be taken to the police station and held in a cell. You are entitled to contact a solicitor of your choosing. You do not have to use the duty solicitor. The police may try to question you first or say they want to have a chat. However, do not say anything until you have spoken to us.

You can call our solicitors 24 hours a day, 7 days a week. We’ll then attend the police station to represent you. This is completely free. Everyone is entitled to legal representation at a police station, so our fees are covered by legal aid.

Getting the right legal advice at the police station is crucial. What you say and do at the station can have a big impact on your case. Without a solicitor, you may accidentally incriminate yourself. Even if you are innocent and having nothing to hide, the police may use something you say against you. Also, your arrest and custody may not be legal.

Our police station solicitors can check whether the police are following the correct procedures. We’ll also provide expert advice while you remain at the police station. This includes during police interviews. Getting our help guarantees the best possible outcome for you. It also costs you nothing because our solicitors are free under legal aid.

If you have been arrested, or your family member has, call us now on 028 71 229 343

Do The Police Want To Question You?

Sometimes the police request that you come in for questioning. Or, you may attend the police station voluntarily to provide some information. Either way, contact our police station solicitors first. Under no circumstances should you go to a police station without a solicitor.

We have dealt with cases in which people have attended a police station for a chat. They are then arrested, spend the night in a cell and find themselves in court the next morning with a duty solicitor they did not choose. Do not let this happen to you. Whatever the situation, always ask one of our solicitors to accompany you to the police station.

All communication you have with a police officer should take place through a solicitor or in the presence of a solicitor. Even things you say on the phone to a police officer can, in some cases, be used in court against you. Having a solicitor at the police station costs you nothing and goes a long way in protecting your position.
