Driving over the Prescribed Limit

There are a number of different offences related to drink driving. The most common is driving while over the prescribed limit. In Northern Ireland, the legal limits for drink driving are –

  • 35 microgrammes of alcohol per 100 millilitres of breath
  • 80 milligrammes of alcohol per 100 millilitres of blood
  • 107 milligrammes of alcohol per 100 millilitres of urine

The penalties for drink driving vary depending on whether or not it is your first offence, and whether or not you caused death or grievous bodily injury. For driving over the prescribed limit alone you could face –

  • Six months’ imprisonment
  • A fine of up to £5,000
  • A driving disqualification for at least 12 months
  • A driving test before your licence is restored

  • Three months’ imprisonment
  • A fine of up to £2,500
  • A driving disqualification

  • A driving test before your licence is restored
